The Hands-Free Law, designed to combat distractions, prohibits all cellphone use while driving, including texting and holding devices. However, it’s classified as a secondary offense, meaning officers cannot stop drivers solely for using their phones. Instead, they must witness a primary violation, such as speeding, occurring simultaneously.
Statewide, the Colorado State Patrol has taken more decisive action, issuing 498 citations for hands-free violations on highways. Trooper Gabriel Moltrer emphasized, “Law enforcement can pull over drivers if an officer witnesses an individual driving carelessly or imprudently while holding a device.” This includes alarming behaviors like using a cellphone while navigating through construction zones or looking at their phones while driving at speeds of 75 mph.
To avoid the $75 fine and two license suspension points for first-time offenders, drivers are urged to utilize hands-free accessories. These include Bluetooth headsets, dashboard mounts, and car speakerphone systems. Notably, the law does not apply to those reporting emergencies.
