Federal prosecutors are advocating for a prison sentence for rapper Tekashi 6ix9ine following a violation of the terms of his supervised release earlier this year. The request, filed in U.S. District Court, outlines a series of incidents that have raised concerns about the rapper’s behavior since his release.
In a recent filing, Assistant U.S. Attorney Jonathan Rebold explained the rationale for seeking incarceration. “While it brings the government no joy to seek a custodial prison sentence for a former cooperator, the court must send a message to Hernandez and other government cooperators — or those considering cooperating with the government — that they are not above the law by virtue of their status as cooperators,” Rebold stated.
The violation stems from an altercation that occurred in August 2023 at a mall in Florida, where a man began heckling 6ix9ine. In the memo, Rebold noted, “Hernandez is now six years removed from his criminal sentencing; yet he still appears unable to control his temper when slighted by a random stranger.” The memo further emphasizes the need for 6ix9ine to learn to “turn the other cheek and walk away from situations like these moving forward.”
Potential Prison Time and Conditions
6ix9ine’s attorney, Lance Lazzaro, countered the prosecution’s arguments by pointing out the challenges his client could face in prison. He indicated that due to 6ix9ine’s past cooperation with authorities, the rapper would likely serve his time in isolation. “Due to Mr. Hernandez’s classification, he always serves his jail time segregated and fully isolated from other inmates,” Lazzaro wrote. “As a result, Mr. Hernandez is given extremely limited social interaction with other inmates and very little time outside to get fresh air and exercise.”
The official sentencing hearing is scheduled for Thursday, where 6ix9ine could face a term of imprisonment ranging from three to nine months. In addition to jail time, prosecutors are seeking a new two-year supervised release term, which would include requirements for substance abuse treatment and anger management counseling.

His mother was home at the time and was held at gunpoint during the break-in. As of now, police have not made any arrests and have not identified any suspects.
